Fees Awarded to Trustees and Professionals

Federal Rule of Bankruptcy Procedure 2013(a) provides:

The clerk shall maintain a public record listing fees awarded by the court (1) to trustees and attorneys, accountants, appraisers, auctioneers and other professionals employed by trustees, and (2) to examiners. The record shall include the name and docket number of the case, the name of the individual or firm receiving the fee and the amount of the fee awarded. The record shall be maintained chronologically and shall be kept current and open to examination by the public without charge. "Trustees," as used in this rule, does not include debtors in possession.

Federal Rule of Bankruptcy Procedure 2013(b) provides:

At the close of each annual period, the clerk shall prepare a summary of the public record by individual or firm name to reflect total fees awarded during the preceding year. The summary shall be open to examination by the public without charge. The clerk shall transmit a copy of the summary to the United States Trustee.

Rule 2013 Reporting Requirements:

The Advisory Committee Notes to Rule 2013 indicate that the reporting requirements do not apply to chapter 12 or chapter 13 trustees. These reports include only chapter 7 and chapter 11 trustees and their professionals. Compensation paid to professionals employed by chapter 11 debtors-in-possession is not reported. Compensation paid to professionals employed by chapter 11 trustees is reported.

The Court has tried to ensure the accuracy of these reports. However, the data for these reports comes from the Electronic Case Filing (ECF) system. The Court has identified certain errors and omissions caused by the ECF system and how trustees and other ECF users docket their pleadings and papers. Steps have been taken to address errors that have been identified by the Court. In addition, professionals are listed by the name(s) used in the ECF docketing process. This may result in separate entries for lawyers within the same law firm, for auctioneers under a personal and/or trade name, and other professionals.
