Signature Requirements

9011-1:   Signature Requirements

LBR 5005-1 requires that proper signatures and fees be included with documents that are delivered to the court for filing.  This includes bankruptcy petitions and schedules AND amended schedules.  LBR 9011-1 governs signature requirements.  

A /s/ is an authorized signature in TWO SCENARIOS ONLY:

  1. The attorney who files a document electronically, using that attorneys CM/ECF password to carry out the filing.
  2. The person who "signs" the proof of service of the document that is being filed electronically.   

A holographic signature is required for all signatures for all other persons or attorneys.  There are no exceptions

  1. Clients of attorneys
  2. Other attorneys who sign a stipulation or who sign off on a proposed form of order
