1006-1:  Filing Bankruptcy: FEES and Exemptions:  Fee Schedule

LBR 1006-1 and LBR 5005-1  require that proper signatures and fees be included with documents that are delivered to the court for filing.  The amount of fees required in bankruptcy court matters are set forth in 28 U.S.C. 1930.

See link below to a chart that identifies documents that require fees and documents that do not require fees.   Instructions are provided for approved methods of making a payment:

  • Pay fees by a money order from the U.S. Postal Service,
  • Pay fees by a cashiers check from an approved financial institution
  • Pay fees by credit card of the attorney of record.
  • Pay fees for certain services using pay.gov, if paid by self-represented parties.

Based on financial status, when a debtor files a bankruptcy case, the debtor may apply to waive the filing fee or pay the filing fee in instalments.  Pursuant to FRBP 1006(b), the initial court order that allows the filing fee to be paid in instalments must authorize no more than 4 payments and require that the total filing fee be paid within 120 days

  • LBR 1006-1(b) -- Application to Waive Filing Fee of a Chapter 7 Petition.  See link below to court form.
