7026-2(d):  DISCOVERY: Request for Original or Copy

LBR 7026-2(d) provides a procedure when an entity that is NOT a party to the proceeding desires a copy of a discovery document.  For example, an entity may request a copy of a deposition transcript, subpoena, interrogatories, etc.  The reason a procedure is needed is the court does not want parties filing discovery documents unless a particular document is at issue.  Often, a discovery document is voluminous and has many pages, which can overburden electronic dockets.

The person or entity who makes the request is NOT entitled to copies of discovery documents if the documents contain confidential information that is protected from disclosure.

1. The person or entity who makes the request must file a form with the court (see below for the form).
2. Then, a clerk will send notice to other parties seeking an original copy of the requested document.
3. After the court receives the original copy of the discovery document, the court will print a copy and send it to the person or entity who requested it. The court will then return the original copy.

NOTE:  This procedure does not apply to PARTIES who are named in the adversary proceeding or in the contested matter.  See LBR 7030-1(a)(3) for the applicable procedure.
