Our court recently condensed all of our Local Bankruptcy Rules related to appeals, into one LBR, that being LBR 8001-1.  This was done to avoid repeating requirements that were already in the Federal Bankruptcy Rules on Appeals, namely FRBP 8001-8028.  Appeals of judgments and orders are typically made to the Bankruptcy Appellate Panel of the Ninth Circuit (BAP) or District Court for the Central District of California.  In some situations an appeal can be made directly to the United States Court of Appeals for the Ninth Circuit.  

These FRBP contain many requirements and parties must consult FRBP 8001-8028 for all rules that must be followed in appellate litigation.

Our court offers forms to accomplish basic requirements only and are not in any way exhaustive of requirements.  See links below

  • Notice of Appeal and Statement of Election:  This form complies with FRBP 8003 and 8005.

  • Certification of Compliance with FRBP 8015(a)(7)(B) or 8016(d)(2):  This form complies with page-length limitations when filing appellate briefs.
