3-09:  Special Tabs: CHAPTER 11, CHAPTER 13, ADVERSARY PROCEEDINGS, AUTOMATIC STAY

All bankruptcy judges have the opportunity to post instructions, procedures and unique forms on their own webpage.  On each webpage, some judges post all of this information in two general TABS -- Currently the general tabs are titled "Forms" and "Instructions/Procedures."  Soon these two TABS will be merged into one TAB titled Miscellaneous Instructions/Forms.

Some judges choose to post applicable requirements under special TABS titled Chapter 11, Chapter 13, Adversary Proceedings, or Automatic Stay.  The reason is these are the four most common topics that lead to special requirements posted by judges.  By March 2022, a project will be completed in which judges may relocate these specialized instructions and forms so that they are posted under the specialized TABS.   If one or more of these specialized TABS does not appear on the webpage of your judge, that means the judge has not posted anything under that TAB.

For the Automatic Stay under Bankruptcy Code section 362(a), LBR 4001-1(b) requires that any motion seeking any relief involving the automatic stay must be filed using the court's mandatory forms. and any order lodged after the court rules must be lodged using the court's mandatory orders.  In addition, the presiding judge may have special procedures for relief from stay motions, including the ability to set a hearing on less than 21 days of notice.   Please consult the judge's webpage under the Self-Calendaring TAB, the Automatic Stay TAB, or Instructions/Procedures TAB to determine if your judge has special procedures.
