Reaffirmation Agreements

4008-1(a):  Reaffirmation Agreements

A debtor may enter into a reaffirmation agreement in order to take a debt owed on an automobile (for example) and agree to remove that debt from being dischargeable.  This is the case for many debtors who want to desire to keep their vehicle even though money is still owed on the car loan. 

  • FRBP 4008 and LBR 4008-1 govern the process.
  • The court requires that mandatory forms be filed.  See links below
  • The Administrative Office of U.S. Courts provides instructions on filing the required forms, because the forms are used in all bankruptcy courts nation-wide.
  • For most reaffirmation agreements, there will be a hearing. 

If a debtor has an attorney, please consult your attorney to determine if a hearing is needed.  After a debtor files a reaffirmation, the court selects a hearing date and sends a notice of hearing.
