Filing Documents: PRIVACY POLICY

1002-1(d):  Filing Documents: PRIVACY POLICY

LBR 1002-1(d) provides that personal identifiers must not be included in documents filed with the court.  Examples of unauthorized personal identifiers are social security numbers, full account numbers, names of minors, full birthdates, and other personal information that is confidential.

FRBP 9037 places the duty of excluding (or redacting) personal identifiers on the party who files the document.  Thus, if a personal identifier is included in a filed document, the court does not take action to redact that identifier.

Please refer LBR 9037-1(a) for a procedure to ask the court to block public access to a filed document, so that a redacted copy can then be filed without the personal identifier.
