1-05:  FILING BANKRUPTCY: Electronically (eSR): Chapter 7 or 13: Self-Represented

FRBP 7005 and FRCP Rule 5(d)(3) authorizes the Central District of California to provide a process for self-represented debtors to submit a Chapter 7 or Chapter 13 petition and related schedules and statements case electronically for the court to file.  This means that instead of submitting all Petition Forms at an intake window, the majority of Petition Forms will be submitted electronically for the court to file.  This process is called ELECTRONIC SELF REPRESENTATION  (eSR).  See links below

There are important features and limits to be aware of when deciding whether to use the eSR program to file a Chapter 7 or Chapter 13 bankruptcy case:

FEATURES OF THE eSR PROGRAM:

  • eSR is available for self-represented Individuals who live in the Central District of California. 
  • eSR is available for Chapter 7 cases and Chapter 13 cases.
  • Most of the Petition Forms are filled out when a debtor logs on to the eSR program. 
  • When uploading a creditor matrix, use the format of a creditor matrix found at page 26 of the Checklist of Forms to File a Bankruptcy Case.  See link below
  • Identifiying some names, addresses, and other identification in a creditor matrix may require referring to a Style Guide.  See link below

LIMITS OF THE eSR PROGRAM:

  • eSR is not available to attorneys or bankruptcy petition preparers. 
  • eSR is not designed for business or corporate bankruptcy filings.   
  • eSR is not available for Chapter 11 cases and Chapter 12 cases.
  • Some Forms can only be submitted for filing at an intake window or by mail.  See link below for a packet of forms to complete an eSR filing.
