1017-1(a)(4):  CHAPTER 7 to 11--12--13; Motion Required

LBR 1017-1(a)(4) provides the procedure for a chapter 7 debtor to request an order converting a chapter 7 case to a case under another chapter. 

  1. A fee may be required.  Please consult the fee schedule.  See link below
  2. A motion is required .  The court provides a form motion -- See link below 
  3. There are two optional procedures a debtor can follow to obtain an order:
  • Schedule a hearing under LBR 9013-1(d) and file a Notice of Hearing.  See link below; OR
  • File a Notice of Opportunity to Request a Hearing under LBR 9013-1(o).  See link below.
