3003-1(a): CLAIMS: Set Deadline to File Claims: Motion, Order, Notice
LBR 3003-1 provides the procedure for a chapter 11 debtor or trustee to file a motion to ask the court to set a deadline for creditors and interest holders to file a proof of claim or interest. This is called a Motion for Bar Date.
- LBR 9013-1(q)(9) allows the court to enter an order without a hearing or additional notice.
- Nevertheless, the chapter 11 debtor or trustee may choose to set a hearing on the motion.
- See links below to the form motion (which contains the required notice of motion) and a form order.
- The court has a form Notice of Bar Date for the debtor or trustee to send to creditors and interest holders after the court grants the motion -- see link below.
- Some judges set claims filing deadlines at a chapter 11 status conference. Please consult your judge's webpage.
