An attorney and a debtor may enter into a fee agreement when a debtor files a chapter 13 case.   LBR 3015-1(v)(1) authorizes use of a "RARA", or Rights and Responsibilities Agreement, which dentifies specific services that the attorney agrees to perform and the specific fee that the debtor agrees will be paid if those services are performed.   In addition, the RARA identifies supplemental services that the attorney agrees to perform, if needed, and then the attorney may file an application to be compensated for those services. 

  • When the debtor and attorney agree to use the RARA, a copy of the RARA must be filed.
