Amendments to Federal Rules of Bankruptcy Procedures and Official Bankruptcy Forms Become Effective December 1, 2010

The Supreme Court of the United States has approved the following rule amendments and new rule: Federal Rules of Bankruptcy Procedure 1007, 1014, 1015, 1018, 1019, 4001, 4004, 5009, 7001, 9001, and new Rule 5012. These rules will take effect on December 1, 2010. Additional information regarding these rules can be found on the Judiciary’s website at

The Judicial Conference of the United States approved amendments to the following Official Bankruptcy Forms which become effective December 1, 2010.

  • Official Forms B9A, B9C, and B9I - Notice of Bankruptcy Case Meeting of Creditors, & Deadlines. Amended to conform to Bankruptcy Rules 4004 and 7001.
  • Official Forms B20A, B20B - Notice of Motion or Objection and Notice of Objection to Claim. Amended to list all names used by debtor in the last eight years from six years.
  • Official Forms B22A, B22B, and B22C - Statement of Current Monthly Income. Amended to delete references to “household” and “household size” and replace “number of persons” or “family size.” Forms B22A, B22B and B22C also amended to clarify that only one joint filer should report regular payments by another person for household expenses.
  • Official Form B23 - Debtor’s Certification of Completion of Instructional Course Concerning Financial Management. Amended to conform to Bankruptcy Rule 1007(c). 

CM/ECF filers may need to update their petition preparation software and/or templates in order to file petitions.

Official Forms B22A, B22B, B22C and B23 will be made available in printed format at the Intake sections of each division for a fee. These forms will also be available on the Court’s website on or before December 1, 2010.
