Honorable Mark S. Wallace

JULY 19, 2021

Re-Opening to In-Person Appearance On and After July 19, 2021

Effective for hearings on and after July 19, 2021, any person may appear in person at any court hearing where Judge Mark S. Wallace is the assigned judge (except for trial, evidentiary hearing, and unless such hearing is closed as a result of it being an in-camera hearing).  During the COVID-19 pandemic, any person choosing to appear in-person at a hearing before Judge Wallace must comply with applicable Centers for Disease Control and Prevention (CDC) guidelines regarding wearing a face mask.  Under such guidelines, a person who is fully vaccinated is not required to wear a face mask.  Judge Wallace, being fully vaccinated, will not be wearing a face mask.  Any person who is not fully vaccinated is required to wear a face mask covering the nose and mouth.  People will be on the honor system regarding these rules.  A person is considered to be fully vaccinated two weeks after (1) their second dose in a two-dose series, such as the Pfizer or Moderna vaccine, or (2) after a single-dose vaccine, such as Johnson & Johnson’s Janssen vaccine.

  1. Prior Court Approval Required

In a departure from past practices and rules, prior Court approval is not required for telephonic appearances.  The Court generally relies upon a list of telephonic appearances generated by CourtCall.  Attorneys and parties wishing to appear at hearings telephonically (as distinguished from “Listen Only”) are urged to contact CourtCall at least by 2:30 p.m, one business day before the hearing.  Otherwise, their names may not appear on the list of telephonic appearances generated by CourtCall.

  1. Conduct During Telephonic Appearances

After CourtCall has connected your phone line to the courtroom please put your phone on mute until your calendar number is called, to avoid interfering with other hearings in progress.  Speaker phones are never allowed.  No cell phones are allowed without a very good reason.  By appearing telephonically, you assume the risks of any and all technical problems that may occur during the call.
