Certification About a Financial Management Course for Debtor 2

IMPORTANT INFORMATION WHEN FILING FORM 423 FOR DEBTOR/JOINT DEBTOR PETITIONS 

  1. Prior to filing, ensure the Form 423 contains the debtor(s) holographic signature, or if electronic signatures are appended, it must be accompanied by the Electronic Filing Declaration, which must contain the debtor(s) holographic signature.
  2. DO NOT select either of these events codes simultaneously with any other events, including each other, i.e, Certification About a Financial Management Course for Debtor 2 and Declaration of Electronic Filing; or Certification About a Financial Management Course for Debtor 1 and Certification About a Financial Management Course for Debtor 2. Doing so creates multiple PDFs on the case and does not properly set or terminate case flags and deadlines, which prevents the timely issuance of the debtor(s) discharge.
  3. On Joint Petitions, each event must be docketed separately with its individual Certification About a Financial Management Course. In joint cases, the Debtor's Form 423 must always be filed first.

Processing Instructions (rev 10/28/2014):

Debtor:

  1. Select Bankruptcy menu.
  2. Select Other.
  3. Enter the case number using correct format and ensure case name and number match the document you are filing.
  4. Select Document event: Certification About a Financial Management Course for Debtor 1. The following reminder message will display: "DO NOT use this event to file the Certificate for the JOINT DEBTOR!!!"
  5. Select the party filer. If not listed, Add/Create New Party.
  6. Have you already filed the certificate for the Joint Debtor, Yes or No?
  7. Select No if you will be filing the Joint Debtor's Form 423 next or at a future date. This will ensure that the case flag and deadline for the joint debtor's Form 23 remains on the case until the document is filed. Select Yes if the Joint Debtor's Form 423 was previously filed, i.e. both Debtor and Joint Debtor's Form 23 were previously filed, but due to an error, the Debtor's Form 423 needs to be re-filed.
  8. Browse, verify and attach the document (PDF file).
    1. Attach additional supportive documents, if applicable.
  9. Modify text if applicable.
  10. Verify final docket text before submitting onto the case docket.
  11. Print the Notice of Electronic filing. This is the verification that the document has been electronically filed.

Joint Debtor:

Ensure that the Debtor's Form 423 is filed with its own event code prior to filing the Joint Debtor's Form 423

  1. Select Bankruptcy menu.
  2. Select Other.
  3. Enter the case number using correct format and ensure case name and number match the document you are filing.
  4. Select Document event: Certification About a Financial Management Course for Debtor 2. The following reminder message will display: "DO NOT use this event to file the Certificate for the DEBTOR!!!"
  5. Select the party filer. If not listed, Add/Create New Party.
  6. Have you already filed the certificate for the Debtor, Yes or No? Select Yes if the Form 423 was previously filed for the debtor, but due to an error, the Joint Debtor's Form 423 needed to be re-filed. Select No, STOP! The Debtor's Form 423 must be filed before the Joint Debtor's Form 423. To file Form 423 for the Debtor, follow the above processing instructions under Debtor.
  7. Browse, verify and attach the document (PDF file).
    1. Attach additional supportive documents, if applicable.
  8. Modify text if applicable.
  9. Verify final docket text before submitting onto the case docket.
  10. Print the Notice of Electronic filing. This is the verification that the document has been electronically filed.
