LBR Appendix IV Revised to Increase Attorneys’ Fees in Chapter 13 Cases

The Board of Judges approved a revision to LBR Appendix IV, increasing attorneys’ fees in chapter 13 cases when a fully executed Rights and Responsibilities Agreement Between Chapter 13 Debtors and Their Attorneys, LBR Form 3015-1.RARA (RARA) is filed.  The new fees become effective with chapter 13 cases filed on or after March 23, 2015, that include the updated and fully executed RARA.

The maximum amount an attorney may charge under the RARA guidelines (excluding the petition fee), increased from $5,000 to $6,000 for cases involving a business (with a maximum amount of $5,000 to be paid prior to confirmation).  For cases involving non-business debtors, the fee increased from $4,000 to $5,000.

, Court Manual Section 2.9, and the RARA were updated to reflect the new fees and are available on the Court’s website www.cacb.uscourts.gov.
